These Terms and Conditions (the "Terms") govern your use of our services, programs, and website. By accessing or using our services, you agree to be bound by these Terms. Please read them carefully before proceeding.
1. INTRODUCTION
Welcome to Central Kyokushin Karate/Ultimate Truth LLC. We are dedicated to supporting your journey towards optimal health and holistic well-being through Kyokushin karate martial arts training. By enrolling in our Kyokushin karate classes and programs, you agree to abide by the following terms and conditions. These terms are designed to ensure a safe, respectful, and productive environment for all students and staff.
2. ENROLLMENT AND FEES
Registration: All students must complete a registration and waiver form before attending any classes. One free class is provided so that prospective students can determine if our classes or programs will meet their needs. Tuition must be paid prior to attending any subsequent classes or programs.
Fees: Tuition fees are due on the first of each month via autopay. Late payments may incur additional charges.
Refunds: Fees are non-refundable except in cases of medical emergencies or relocation, with appropriate documentation, or as determined by official staff.
3. CLASS ATTENDANCE
Punctuality: Students are expected to arrive on time for classes. Late arrivals must kneel or sit quietly on the side until acknowledged by instructors. Significantly late arrivals may be disallowed from participation at the sole discretion of instructors.
Attendance: Regular attendance is crucial for progress. Students must inform instructors in advance if they will miss a class
4. UNIFORM AND EQUIPMENT
Uniform: All students must wear the official Kyokushin karate uniform or dogi during classes. Uniforms must be clean and in good condition.
Equipment: Students are responsible for their own protective gear, including gloves, shin guards, mouthguards, and athletic protective cup, as appropriate. All equipment must be purchased through the dojo to ensure safety compliance.
5. CODE OF CONDUCT
Respect: Students must show respect to instructors, fellow students, and the dojo at all times. Proper means to show and conduct oneself with respect are outlined in the Code of Conduct at ultimatetruthllc.com.
Behavior: Any form of bullying, harassment, or disruptive behavior will not be tolerated and may result in suspension or expulsion at the sole discretion of dojo officials. Once a person has been expelled there is no process for appeal other than through Shihan Ian Quitadamo.
Safety: Students must immediately follow all safety instructions and always use equipment properly to prevent injuries.
6. HEALTH AND SAFETY
Medical Conditions: Students must inform the school of any medical conditions or injuries that may affect their training.
Injuries: Preexisting injuries must be reported to both the instructor and potential class partners prior to training. Any injuries sustained during training must be reported to the instructor immediately.
Hygiene: Students must maintain good personal hygiene and keep their nails trimmed to prevent injuries.
7. GRADING AND PROGRESSION
Belt Tests: Students will be eligible for belt tests based on their attendance, skill level, and instructor’s recommendation. Time alone will not determine suitability for belt testing. No students are guaranteed rank promotion. Rank promotion is based solely on the judgment of Shihan Ian Quitadamo and dojo staff.
Progression: Advancement through the belt ranks requires sustained dedication, practice, adherence to the school’s curriculum, proper execution of required techniques, and ability to adhere to dojo code of conduct. Suitability for progression is based solely on the judgment of Shihan Ian Quitadamo and dojo staff.
8. TERMINATION OF ENROLLMENT
Voluntary Withdrawal: Students wishing to withdraw from dojo classes or programs must provide written notice at least 15 days in advance. Failure to adhere to this policy will result in continuation of fees for the next month, after which point termination will occur.
Expulsion: The school reserves the right to expel any student who violates these terms and conditions or engages in conduct detrimental to the school. Shihan Ian Quitadamo may remove any student at any time from classes or programs if he deems it necessary.
9. LIABILITY WAIVER
Assumption of Risk: By enrolling in and participating in any class, seminar, workshop, event, or other activity offered by Central Kyokushin Karate / Ultimate Truth LLC, you acknowledge that martial arts training involves inherent risks, including but not limited to physical exertion, personal contact, self-defense techniques, falls, impact with training partners or equipment, and the possibility of injury (including serious injury, disability, or death). You voluntarily choose to participate in these activities with full understanding and acceptance of these risks. Every student must have a signed liability waiver on file prior to beginning training.
Release of Liability: By participating in any program or service provided by Central Kyokushin Karate / Ultimate Truth LLC, you (and/or your child or dependent) agree to fully release, discharge, and hold harmless Ultimate Truth LLC, Central Kyokushin Karate, Shihan Ian Quitadamo, dojo instructors, assistant instructors, staff, volunteers, and any associated parties from any and all liability, claims, demands, causes of action, damages, or expenses (including attorney's fees) arising out of or in connection with participation in martial arts activities, whether caused by negligence or otherwise, to the fullest extent permitted by law.
This release includes, but is not limited to:

Injuries sustained during class, demonstrations, testing, sparring, or outside events

Injuries caused by other participants, equipment failure, or facility conditions

Emotional or psychological distress

Exposure to communicable diseases, including COVID-19 and related variants
Medical Responsibility: You affirm that you are (or your child is) physically capable of participating in martial arts training and have not been advised otherwise by a medical professional. You are solely responsible for consulting a physician regarding your fitness for participation. You assume full responsibility for any medical costs associated with training-related injuries and agree that Central Kyokushin Karate / Ultimate Truth LLC is not liable for any such expenses.
Emergency Care Consent: In the event of a medical emergency, you authorize the dojo staff to administer first aid and/or seek emergency medical treatment, understanding that reasonable efforts will be made to contact the emergency contact provided. You waive any claim against Central Kyokushin Karate / Ultimate Truth LLC and staff for the provision or lack of provision of such care.
Voluntary Participation:
You confirm that your participation (or that of your minor child/dependent) is voluntary and that you have had the opportunity to ask questions and consult with legal or medical professionals prior to agreeing to these terms.
